A 40-year-old Sandy man faces six first-degree felony charges and two third-degree felony charges after he allegedly sexually abused a 10-year-old girl during a sleepover at his home on July 2.

Jacob Richard Fitzgerald was arrested and booked into the Salt Lake County Jail without bail, according to court documents first reported by ABC4 Utah's Sorina Trauntvein. The Sandy City Police Department investigated the case.

The charges include three counts of aggravated sexual abuse of a child, two counts of sodomy upon a child, one count of object rape of a child and two counts of distributing material harmful to a minor.

The allegations

The victim was sleeping over at Fitzgerald's home with friends while her parents were on a double date with Fitzgerald and his wife, court documents state. He was the only adult home.

According to the charging documents, Fitzgerald allegedly woke the sleeping child and sexually abused her. He later woke her a second time, brought her to another room, showed her pornographic videos on his phone and allegedly assaulted her again. He then told her to "keep it a secret," the documents allege.

The victim's parents confirmed to police that they went to dinner with Fitzgerald and his wife on July 2 and that their daughter spent the night at his home.

Potential penalties

Under Utah law, each count of aggravated sexual abuse of a child carries a mandatory minimum of 15 years to life in prison. Sodomy upon a child and object rape of a child each carry mandatory minimums of 25 years to life. Sentences could run consecutively.

The two third-degree felony counts for distributing material harmful to a minor stem from the pornographic videos Fitzgerald allegedly showed the child.

In a separate, unrelated case, two Sandy men were charged Aug. 4 with sexually abusing a 12-year-old neighbor.
