Sandy police arrested a 30-year-old man accused of shooting another man in the foot at the AXIO apartment complex. Carl Devon Hardy allegedly fled toward Wyoming before investigators tracked his car through license-plate reader data.
Hardy faces charges of aggravated assault resulting in serious bodily injury, felony discharge of a firearm, prohibited dangerous weapon conduct and use of drug paraphernalia, as first reported by ABC4 on Monday, Sept. 21, citing court documents.
The shooting happened around 9:45 p.m. Thursday, Sept. 17, at the AXIO complex in Sandy. Two victims told officers they had been in a nearby parking lot when people on an apartment balcony began "squaring up" to them and trying to start a fight, according to court documents.
The victims left but returned a short time later. One reported that a man came out of the apartment complex and opened fire.
Both ran.
One was struck in the foot and later taken to a hospital. Fearing the shooter was following them by car, the two jumped into a canal near 8400 South State Street. Officers eventually found them there.
Sandy patrol officers identified Hardy as a suspect using descriptions the victims provided. When they determined he was not home, they entered his vehicle information into a license-plate reader database. The system recorded his car traveling eastbound on Interstate 80 near Emory, heading toward Evanston, Wyoming.
One of two other men involved in the confrontation told police Hardy "fought past" them to go downstairs and confront the victims. According to court documents, the man said that when the group approached the victims, "Carl got crazy and started doing his thing."
After the shooting, Hardy called one of the men and said he was leaving and turning off his phone, court documents state. The next day, he called again and said he was somewhere he could gamble.
Apartment complex video showed Hardy appearing to point something down a stairwell. One of the men told police Hardy had dropped bullets, which the man picked up and brought inside. Minutes later, the footage showed the three men and a girlfriend leaving the area by vehicle.
Hardy was interviewed at the Sandy Police Department on Sunday, Sept. 20. He told officers "it was a heavy night of drinking," then asked whether he was being charged, according to court documents. After officers read him his rights, he declined to comment further and was placed under arrest.
The arresting officer requested Hardy be held without bail, citing his attempt to leave the state after the shooting. Two other men involved in the incident were interviewed but have not been arrested.
Sgt. Michael Olsen of the Sandy Police Department had described the Sept. 17 shooting as an isolated incident with no threat to the general public, ABC4 reported at the time.
No arraignment or next court date has been announced.
